This Selfie Contest is organised by  Vapusa ECommerce Solutions LLP (from here onward called Vapusa.com or Vapusa) and by participating in the contest, you hereby agree to be bound by this terms and conditions. Failure to comply with any applicable terms, conditions, rules, regulations, instructions or methods determined by Vapusa shall result in you being disqualified from the Contest.

1. ELIGIBILITY

1.1 This Contest is open to all Indian citizens with a valid Indian Identity and addressed in India aged 18 and above as of 1st September 2019

1.2. The following group of person shall not be eligible to participate in this Contest

1.3. Permanent or contract employee of Vapusa (including its associated or related companies and their immediate family members, and/or

1.4. Representatives, employees and/or agents of the contents, advertising and promotional services providers for this Contest and their immediate family members.

1.5. Vapusa shall have the right to reject and/or disqualify your participation if you fail to fulfil the above eligibility criteria.

2. CONTEST DURATION

2.1. This Contest will run from 1st September to 30 th September 2019

2.2. Vapusa reserves the right at its sole discretion to change, vary and amend the Contest Period at any time. All entries received outside the Contest period will be disqualified.

3. HOW TO PARTICIPATE

3.1. Like our Facebook page Vapusa.

3.2. Share the Contest post on your wall.

3.3. Post your selfie on your Facebook with hashtags #selfiewithkeralasaree #vapusa

3.4. Share your Selfie Post on Vapusa’s page.

4. HOW TO WIN

4.1. There shall be only one winner selected by Vapusa panel judges from the eligible participants.

4.2 The winner is selected based on criteria like photo, post reach, engagement, likes received etc. for the selfie submitted by the Participant.

4.3 For the avoidance of doubt, each Participant shall only submit only one Selfie to us.

4.4 The selection of the above mentioned panel of judges shall be at Vapusa’s sole discretion. Vapusa has the sole discretion whether to disclose the names of the panel judges or otherwise.

4.5 You agree that Vapusa shall have the rights to set the criteria required for the purpose of selecting the winners.

4.6 Vapusa's decisions of winner’s selection are final and no complaints and/or claims thereon will be entertains.

4.7 Irrespective of the any other provisions in the T&C, this Clause 4 shall provide the sole provisions with respect to the selection of winners in the Contest.

5. PRIZES

5.1 Authentic Hand woven Kerala Saree from Vapusa (Current Price worth Rs 4900/-) 

6. WINNERS ANNOUNCEMENT AND REDEMPTION

6.1 Winners will be announced in the first week of October

6.2 Prize will be shipped to the winners address provided by them

7. OTHER TERMS AND CONDITIONS

7.1 Each entry submitted must complete all the steps in the Contest. Any incomplete entries will be automatically disqualified.

7.2 Each participant may submit multiple entries But only one entry will be selected for the contest. Selection of one post from multiple posts submitted  by a participant is judges decision

7.3 In the event of similar, copied or plagiarised submissions from different participants, the earliest submitted entry will be treated as the valid entry based on the time of receipt.

7.4 Participant shall assume full liability mishap, injury, damage, claim or accidents (or death) resulting from their participation in this contest, redemption and/or utilisation of the prizes. Vapusa shall not be responsible for any liability, mishap, loss, damage, claim or accident (including death) in any manner.

7.5 All photography, transportation, accommodation, personal costs and/or other expenses that are incurred to participate in this contest and to redeem the prize is the sole responsibility of the participant.

7.6 Vapusa is not responsible for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications, or any problems or technical malfunction of any telephone network or line, computer online systems, servers or providers, computer equipment, software, failure of e-mail or players on account of technical problems or traffic congestion on the internet and/or websites.

7.7 Participants also agree that Vapusa is not responsible nor liable for any delay, injury or damage to the participant’s and/or any third party’s computer, computer systems or apparatus relating to or resulting from the access to, participation in this contest, including the playing, downloading of any materials or information from alternative Facebook page or website and in connection with this contest, submission/uploading of the photos for this contest, including without limitations any server failure,, lost, delayed or corrupted data or other malfunction

7.8 The alternative Facebook page or website is provided on an “as is” basis and, except as otherwise prohibited by applicable law, Vapusa expressly disclaims any warranty of any kind, including, but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. Vapusa cannot guarantee and do not promise any specific results from use of the alternative Facebook page or website shall create any warranty not expressly stated here in.

7.9 By submitting your entries for this contest, all participants agree, consent and acknowledge that all intellectual property right there to in relation to all materials (including but not limited to your selfie as mentioned in clause 4 and 5 above) you submitted in this contest shall belong to Vapusa. Vapusa shall have the exclusive rights to use, edit, modify and modify and publish and republish the entry submitted by all the participants, publish and republish the names of the participants, in any way it deems fit for any advertising, trade, promotional purpose and for any other reason whatsoever, without any further notice to the participants and the participants shall not claim ownership or any form of payment or compensation on the materials. For the avoidance of doubt, the submissions will not be edited for judging purposes.

7.10 Vapusa reserves the right to modify, suspended or cancel this Contest in the event that it becomes not capable of running as planned, technically interfered or corrupted, including but not limited to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Vapusa, despite the best efforts of Vapusa. In furtherance thereto, Vapusa reserves the right to stop, suspend or cancel this contest due.

7.11 Vapusa reserves the right, in its sole discretion, to disqualify any participant that is found or suspected of tampering with the contest submission process, the operation of this contest or to be in violation of the conditions of access of the alternative Facebook page or website. Vapusa reserves the right to terminate the alternative Facebook page or website member account of any person who it reasonably suspects has violated or infringed any of these general terms and conditions and Vapusa reserves the right to pursue legal action against any individual it believes has undertaken fraudulent activities or other activities harmful to this online contest, the contest submission process and/or the alternative Facebook page or website.

7.12 Vapusa should not be held liable or responsible for any delay and/or failure in the receipt of entry due to the inability of the respective internet service provider [ISP] company and/or telecommunication network to provide timely and/or telecommunication services.

7.13 Without prejudice to our rights in clause 8.9 above, all entries submitted in this contest must be your work and it is original and shall not breach any intellectual property rights belonging to any party and you provide your representation and warranty in this regard. The participants shall not pose, distribute, reproduce or submit in any way whatsoever, any other party’s intellectual property rights, including but not limited to copyrights, or other proprietary information owned buy another party without obtaining the prior written consent of the owner of such intellectual property rights or proprietary information. If you believe that your work has been copied and posted in a way that constitutes an intellectual property infringement, please contact Vapusa. You shall fully indemnify Vapusa for any infringement of intellectual property rights caused by you.

7.14 Vapusa, in its sole discretion, reserves the right to modify this terms and conditions without any prior notice, if required for the smooth running of the contest

7.15 This T&C are prepared in English.

7.16 The Laws Governing this T&C shall be the laws of India and you irrevocably submit to the exclusive jurisdiction of the courts in Chennai only.

7.17 Unless the context otherwise requires, the following terms shall have the corresponding meaning: “VAPUSA”,”Our”,”Us”,”We” shall refer to Vapusa Ecommerce Solutions or Vapusa appointed agents or representatives. “Participant or you” shall interchangeably be used and mean the person who participates in the Contest.

8. DISCLAIMER

8.1 We shall not be responsible and liable for any damages or loss incurred by you arising out of the use or otherwise of any prize item in any way whatsoever.

8.2 In no event shall we be liable for any losses and/or damages whatsoever (including without limitation, for loss of profit, business interruption, loss of information, indirect, special, incidental or consequential losses or damages) arising out of your participation or inability to participate, even if we have been advised or should have known of the possibility of such damages and/or losses.

8.3 For avoidance of doubt, our total cumulative liability for any and all claims in connection with this Contest, shall not in any way exceed Indian Rupees Five Hundred (INR 500).
